Design-build firms would use D-580, Teaming Agreement to Pursue Joint Business Opportunity for Design-Build Project when they wish to work with an engineering firm to pursue a design-build opportunity. The design-build and engineering firms commit to a design services agreement if the proposal is successful. EJCDC published the new D-580 agreement recognizing that, in many cases, working together as a team will substantially increase and enhance the likelihood of being selected to provide design-build services. This contract provides the basic structure for combining forces to prepare and submit proposals to provide professional design-build services, and addresses important risk and cost allocation issues.
D-580 sets forth the Team Goal of the design-builder winning, accepting, and formally entering into the design-build contract, and then entering into a design contract with its engineering teammate. If the Design-Build Team is successful in reaching the Team Goal, then D-580 seamlessly meshes with D-505, Subagreement between Design-Builder and Engineer for Professional Services, as the controlling professional services subagreement.
EJCDC includes the American Society of Civil Engineers, the American Council of Engineering Companies, the National Society of Professional Engineers, and the participation of more than fifteen other professional engineering design, construction, owner, legal, and risk management organizations.
